Can anyone offer up some advice concerning employment law? I just have a few questions ! If not can anyone recommend someone!
Much Appreciated!
Trevor K.: Falsifying an ROE is fraud -- I agree with Traci -- mistakes happen, and it seems unlikely (and foolish) that the employer would mess with the federal government -- it's probably easier (if they want to have accurate hours for potential EI) to inform t he employer first...otherwise, they're risking a bureaucratic mess of red tape over something that could be easily corrected. They likely have pay stubs to back up their actual hours, so it would be completely insane of the employer to try to argue otherwise. If they're feeling a little spunky, they can print out the little snippet below and send it along. AS for the "favouritism" - (to be candid) - who cares? Speaking on behalf of the employer, they can choose whomever they want to work when they want. The bigger question if whether there was constructive dismissal -- you mention they were hired "full time" -- which they may be assuming automatically means "40 hours" -- there is no such legal definition -- for some employers, that may be defined as "between 24 and 48 hours" -- for others its 37.5, and so on.... And it all depends on the discussion (or better, documentation) of what was to be provided with their employment. Also, in an ideal world, slow downs wouldn't happen, but economic forces rule the day. If there are no hours for a while...well, that happens -- EI actually accepts claims for those situations - if there's a shortage of work, well, there is shortage of work. What I'm getting at is, there are so many variables here, and unanswered questions, its difficult to draw any hard conclusions. Further complicating the matter is that the employee found other work, meaning that...well, they may not have lost much anyways. Without further information, I'd be cautious about going forward... http://www.servicecanada.gc.ca/.../fraud/fraud_serious.shtml
Traci G.: Is it illegal for your employer to fill out your ROE form wrong deliberately? If, there is a dispute on the ROE have the person that received the ROE contact the employer by writing (keep a copy) informing them of the wrong. Give the ex employer 15 days to fix. If not fixed report this to Service Canada.

I'm hoping with this post someone local can provide me with some information or might even know someone that can help me out. My babysitter decided to up and quit on us yesterday. This puts us in a very hard place especially since right now I need to be at work because we are still trying to recover financially from all the time off I had to take while Mady was in the hospital. We are behind on everything and I need to work to help our family out so the option to stay home isn't there. Does anyone local to us know a good daycare or someone that could do daycare for us? We don't qualify for daycare subsidy ( we applied but were denied) and I would need to find something for 3 out of my 4 kids ( 1 schools aged and 2 toddlers). We would prefer to try to find someone that could come to our home to watch the kids as it would be easier but at this point i'm in such a bind i'm willing to look at all options. If anyone can provide me with links for resources or knows someone looking to babysit or can provide us any help at all please let me know. I need to find something and fast as I work Monday ( i'm at work right now but daddy is at home with the kids). Any help at all would be appreciated!
Love F.: Did you ever look at IMPORTANT INFORMATION FOR PARENTS IN CANADA WITH CRITICALLY ILL CHILDREN THE GOVERNMENT IS EXPANDING SICK BENEFITS FOR PARENTS "The Canadian Government have made changes to the Employment Insurance Act to support parents of critically ill children for upto 35 weeks, instead of the usual 15 weeks of sick benefits. I thought it may be something you would mention as it would apply to many other parents who are like me taking time from work to look after their ill child. More information can be found at www.servicecanada.gc.ca. Thanks and have a good day. Bienvenue Service Canada | Welcome to Service Canada www.servicecanada.gc.ca
